Overview

The purpose of this workshop is to understand how DEDs impact the application of legislation and requirements.

Task

Using pen and paper or the whiteboard, match the following terms (A to E) with the correct Definitions (1 to 5) and provide a work based example of ‘What this means to me’.

Definitions

  1. The Secretary of State (SofS) for Defence is empowered within the legislation to exempt MOD personnel, activities or equipment from part or the whole legal requirement by issuing a formal document to that effect.
  2. A relaxation or lessening of a legal requirement to allow the MOD to apply the law differently for reasons specified within legislation.
  3. Where Specific legislation, or part of it, does not apply to the MOD and this freedom is expressly stated in the legislation.
  4. Authorisation granted by the DMR for the Accountable Person to deviate from the requirement of a DMR Regulation, granted to satisfy an overriding operational requirement, and where it is demonstrated that compliance is not reasonably practicable.
